CCCR Compliance: What are you providing in your kit?

Did you know if you sell a kit with an additional ‘vessel’ or empty cup,  that the empty container MUST BE LABELED IN ACCORDANCE WITH THE CCCR IF HAZARDOUS?

As confirmed with Health Canada this week, if you are selling a kit where the intention is to mix two completely different chemicals to form a new chemical, it TOO must be labeled correctly.

Many companies are not doing this and there is a risk of non-compliance if you do not provide the users this information. The users need to know both the information on the before reaction and the final reactions.

Health Canada kindly provided the definition of a container and it’s important to take note of what they consider a container:

container means

  • (a) a Category 5 pressurized container that is or is likely to be used by a consumer, including an empty container, as described in Part 5;
  • (b) an empty container that is destined for use by a consumer to store or dispense a chemical product; or
  • (c) any other container that is or is likely to be used by a consumer to store or dispense a chemical product.

Therefore, the cup that you are mixing products A and B to form Product C holds the final chemical product. This too would need to be labeled under CCCR according to its hazards, as determined through the hazard classification review from the Regulation.
